LA CROSSE, Wis. — A Wisconsin judge has decided to stick with her previous ruling that a Ten Commandments monument in a La Crosse, Wis., park is unconstitutional.
Chief U.S. District Judge Barbara B. Crabb in Madison set aside her July 2003 ruling last September to permit the Fraternal Order of Eagles, which owned the monument, to be a party of the suit.
She made a final ruling Feb. 3 on the case concerning the placement of the monument in a city park.
The suit, which was filed by the Freedom from Religion Foundation, prompted the city to sell the portion of land around the park to the fraternal organization.
But Crabb determined for a second time that the sale was not a constitutional way to resolve the dispute.
Crabb said the city must remove the monument from the park because it “cannot be constitutionally displayed in its current setting.”
The American Center for Law and Justice, which represented the fraternal organization, plans to appeal the case.
