MEDINA, Ohio — An unborn child injured in a car accident can sue, an Ohio county judge ruled. Judge Christopher Collier ruled in July that Sarah Leinweber of Elyria was a “viable child” when injured in a 1997 auto accident two months before her birth. The judge said Leinweber has the right to sue for damages because she was “capable of existing independently” at the time of the accident, and thus had legal rights. The ruling has implications for abortion cases.
