DENVER — The Colorado Supreme Court on June 28 declared the state’s school voucher program to be unconstitutional because it removes control over education from local school boards.
The 4–3 decision upheld a lower court ruling, the Associated Press reported. Colorado’s voucher law had not been put into effect because of legal challenges. It was the first passed in the country after the U.S. Supreme Court upheld voucher programs in 2002.
The Colorado high court said the voucher program violated the local control provisions of the state constitution because it required school districts to turn over some locally raised funds to private schools, which local school boards do not control.
